Most Police records are considered public records www.leg.state.fl.us and cannot be altered or changed unless they have been sealed, expunged or court ordered by a judge. Therefore, if in conjunction with a case, you were arrested and taken to jail, then that public record will always be available unless one of the above mentioned orders were issued. If the State Attorney dropped the charges, then contact the Clerk of the Court for the final disposition of that case. If you have further questions for what is appearing on your criminal history with the state, contact the Florida Department of Law Enforcement at www.fdle.state.fl.us

Florida State Statute 316.066(5)(a) states that crash reports are confidential for a period of 60 days after the report is filed. However, such reports may be made immediately available to the parties involved in the crash, their legal representatives, their insurance companies and agents, prosecutorial authorities, victim services programs, and certain print and broadcast media as described in the exemption. All must have proper ID and/or written consent within the first 60 days from date of occurrence to obtain a copy of the accident report. The owner of a vehicle involved in a crash is also among those authorized to receive a copy of the crash report immediately with proof of ownership.
Florida Statutes, s.943.0585 and s.943.059, set forth the criteria that must be met in order to be eligible to have a criminal history record sealed or expunged. In addition, these statutes also state that in order to have a criminal history record sealed or expunged within the State of Florida, an individual must first complete an application to the (FDLE) Florida Department Of Law Enforcement for a Certificate of Eligibility www.fdle.state.fl.us.   Please note that the issuance of a Certificate of Eligibility does not mean that your criminal history record will be ordered sealed or expunged. It merely indicates that you are statutorily eligible for the type of relief that is being requested. The FDLE provides applications for Certification of Eligibility to the Clerk of Courts in all sixty-seven (67) counties throughout the State of Florida. These application packages may be obtained from the Palm Beach County Clerk of the Court at www.mypalmbeachclerk.com  If you reside outside the State of Florida, you may request that an application package be mailed to you from the Clerk of the Court. Once this packet has been completed, accepted by the Clerk of the Court, Florida Department of Law Enforcement and the State Attorney’s office, this agency will be notified and court ordered to follow either the seal or expungement order as outlined in the court documents. You will not be required to provide the Palm Beach County Sheriff’s Office with any documents as this will come directly from the Clerk of the Court.
There is one type of background check available to you from this agency; It is a local background check only. The information provided is only generated from a booking within the Palm Beach County Sheriff’s Office corrections facilities or a police report and/or record generated by the Palm Beach County Sheriff’s Office. For all others, contact the municipality that generated the report within their jurisdiction. Other background check related documents the Palm Beach County Sheriff’s Office provides are:
  • Adoption letters
  • International Adoption letters
  • Fingerprint verification letters
Note: Due to the possibility of more than one individual having or having used the same name, a background search could reflect the record of an individual other than the person you are inquiring about. The background response is based on a name check ONLY within the Palm Beach County Sheriff’s Office database and the results may not have been verified by fingerprints. The record(s) may also be inconclusive. However, to get the best possible match, the full name, date of birth, and if available, the social security number, would be the best information to provide when researching an individual for an accurate background check. A fee of $3.00 is required per name for all background checks. The Florida Department of Law Enforcement maintains the criminal history list of all arrests within the State of Florida. For a Criminal History Background check, log onto the FDLE website for information www.fdle.state.fl.us
Florida State Statute 119.07 allows public records requests to be responded to in a “reasonable amount of time to retrieve the record and delete those portions of the record the custodian asserts are exempt.” This can not be defined in days, hours or minutes as each request is unique within itself. The Central Records Division strives to fulfill all requests as quickly as possible. Coupled with application of law(s) and accountability of completeness, we strive to provide the best records possible within the law and within a reasonable time frame.
The only records available from these other agencies are those that were created by the police departments. Any other departments within the cities would have their own records and should be contacted directly. The following are those agencies we have records on file for:
  • Lake Park PD
  • Pahokee PD
  • South Bay PD
  • Belle Glade PD
  • Royal Palm Beach PD
  • Mangonia Park PD
  • Lake Worth PD
  • Greenacres PD
Access to the records are the same as they are for Palm Beach County Sheriff's Office and the procedures outlined above are the same. **Note, we do not have police reports on file for those agencies that are not under the jurisdiction of the Palm Beach County Sheriff's Office. You must contact those agencies directly.
Florida State Statute 119.07 along with other Florida State Statutes, call for certain information to be considered exempt and/or confidential from inspection. Therefore, before we release a report or document, it is reviewed and the information meeting these requirements is removed or redacted . For further information on exemptions by law, go to: Florida Sunshine Law
The Final disposition of a case is determined by the State Attorney’s Office www.sa15.state.fl.us and on file with the Clerk of the Court www.mypalmbeachclerk.com
